4. ACCEPTABLE USE POLICY

4.2. This AUP determines boundaries of acceptable and unacceptable behaviour of our network and resources by you and contributes to the development of a responsible and responsive electronic consumer culture in South Africa.
4.3. We reserve the right to monitor the use of our network and resources and to take any action we deem appropriate against a person/s that uses the network or resources in a manner that we deem inappropriate.
4.4. Our network and resources may only be used for lawful purposes and activities. We strictly prohibit any use of our network/resources for any unlawful activities including but not limited to:
4.4.1. Any violation of local and international laws prohibiting child pornography; human trafficking; obscenity; unfair discrimination; hate speech and speech designed to incite violence or hatred or threats to cause bodily harm;
4.4.2. Any activity designed to defame, abuse, stalk, harass or physically threaten any individual including any attempt to link to, post, transmit any inappropriate or defamatory material;
4.4.3. Any violation of intellectual property laws including materials protected by local and international copyright, trademarks and trade secrets. We cannot be held liable for any unlawful use of multimedia content accessed using our network/resources;
4.4.4. Any fraudulent or inappropriate activity whatsoever by you, including dubious financial practices, such as pyramid schemes, the impersonation of another subscriber without their consent, or any attempt to enter into a transaction with us on behalf on another subscriber without their consent;
4.4.5. Any activity that results in the sale, transmission or distribution of pirated or illegal software;
4.4.6. Should we determine that your use of the Website, Products violates any of the acceptable use conditions as set out above, we reserve the right to terminate your account with us with immediate effect and reserve the right to take all lawful remedies permitted by the ECT Act.
5. TERMS OF TRADE
5.1. Invitation to do business
5.1.1. The Products which appear on the Website are displayed as an invitation to do business and to allow you to make an offer to purchase the Products from Zion Digital (Pty) Limited. Only when the Website Sales Team has communicated acceptance of your offer and capability to fulfil the order will an enforceable agreement of sale be transacted. This communication of acceptance from the Website Sales Team can only be communicated to you once we have confirmed stock from our suppliers.
5.1.2. The price of any Products sold on the Website is payable in South African Rand and is inclusive of value added tax.
5.2. Place and time of agreement
5.2.1. Agreement as to the terms of use of the Website shall be deemed to have be accepted by you at the time that you first accessed the Website and thereafter confirmed each time that you access the Website and shall be deemed to have taken place in the Republic of South Africa.
5.2.2. All communications with us facilitated by the Website Sales Team our Support Call Centre or email communicated between us shall be deemed to have been received, in the case of communications initiated by us when the communication leaves the website or email server, and in the case of communications initiated by you, when it is received on the Website or email server.
5.2.3. Agreement and acceptance by us of an order placed by you shall be deemed to have been made and an agreement entered into, when communication of the acceptance leaves the Website or email server.

Warranty Support
All electronic products sold by Zion Digital (Pty) Limited carry their full manufacturer’s warranty as stipulated by the official South African distributor, unless otherwise stated. Products under warranty are sent to the relevant supplier or manufacturer for repair or replacement. Such manufacturer guarantee is restricted to the costs of repair or replacement of faulty goods or refund of the purchase price at the sole discretion of Zion Digital (Pty) Limited and its suppliers after investigation and/or testing of goods.
Guarantees are immediately null and void if equipment has been tampered with, warranty stickers have been removed, and seals on equipment have been broken by anyone other than the suppliers or manufacturer’s representative. No writable media such as CD-R, CD-RW, DVD-RW may be returned under an electronic hardware manufacturer guarantee.
Please note that we conform to the Consumer Protection Act of South Africa, and as such there is no general right of return. If you have a change of mind and would like to return your purchase, we may be obliged to charge a 30% handling fee.
Faulty products
If a product is faulty, you need to let us know within 7 days of receiving it, and before returning it to us. We will gladly make arrangements for the faulty product to be returned to us for testing. If no fault is found, the product will be returned back to you and a R350 assessment fee will be charged. Should the unit prove to be faulty, depending on the fault and the product supplier, we may offer you a refund or replacement unit.
Notwithstanding the circumstances, if you discover that a product is faulty, and it is over our 7 day return period but it is less than 30 Days from the time you received it, we will make arrangements for the faulty product to be returned to us for testing. If no fault is found, the product will be returned back to you and a R350 assessment fee will be charged. Should the unit prove to be faulty, depending on the fault and the product supplier, we may send the unit in for repairs, or offer you a replacement unit, or offer a refund.
Please check all products delivered to you and do NOT accept delivery of any product that is visibly damaged. Should you accept a product and only later discover that the product is damaged, you need to report this to Zion Digital (Pty) Limited within 24 hours, so that we can assess if the product damage occurred post-delivery.
Faults resulting from normal wear and tear, including products that have been damaged or altered in any way either by you, or anyone that is not an employee of Zion Digital (Pty) Limited or the product’s manufacturer, will not result in any product repair, replacement or refund.

Returns
Non- defective Products- Right to “cool off”:
Products which are NOT defective or damaged or which you found to be unsuitable, can be returned to Zion Digital (Pty) Limited within Seven workings days from date of delivery, provided that the Products have not been opened and the packaging is in its original condition and you are able to produce the original invoice/ credit card/ debit card slip as proof of purchase. You are then entitled to cancel the sale of the Products in terms of Section 44 of the ECT Act within 10 (ten) working days after your receipt of the Products and to obtain a full purchase price refund, subject to being charged a 10% (of the retail price) fee in respect of return and handling charge to non-defective returns that have not been opened and remain in the original packaging. Zion Digital (Pty) Ltd can hold you liable for any damage caused to the Products whilst it is in your possession. Unfortunately, should the product be opened or used in any way, you may not return the product to us nor can we offer you a refund.
If in the case you wish to return your purchase and it is over 7 working-day return period and is less than 30 days from the time you received it, we will gladly collect and provide you with a refund, minus an admin fee of 10% of your total order value, provided the product is in its original condition and original packaging, and has not been opened or used in any way. Unfortunately, should the product be opened or used in any way, you may not return the product to us nor can we offer you a refund.
No returns, refunds or exchanges will be accepted 30 Days after the date of purchase.
Special offers and demo products
If you would like to return a product purchased on “special” and such product price is still valid, let our customer service team know within 7 working days and we will gladly collect and provide you with a refund to the amount it was purchased at, minus an admin fee of 10% of your total order value, provided the product is in its original condition and original packaging, and has not been opened or used in any way. Unfortunately should the product be opened or used in any way, you may not return the product to us nor can we offer you a refund.
Should you wish to return a product purchased on “special” and such product is no longer available at this sale price, let our customer service team know within 7 working days and we will gladly collect and provide you with a refund to the amount it was purchased at, minus a admin fee of 10% of your total order value, provided the product is in its original condition and original packaging, and has not been opened or used in any way. Unfortunately should the product be returned to us and has been opened and/or used in any way, we will offer you a refund however you may be liable for a 40% (of the original purchase price) handling fee.
Please note that if you have purchased a demo unit, we are unable to give you a refund. All demo units are tested before going on sale. Should the product be faulty, you need to let us know within 7 working days of receiving it, and before returning it to us. We will gladly make arrangements for the faulty product to be returned to us for testing. If no fault is found, the product will be returned back to you and a delivery fee will be charged. Should the unit prove to be faulty, we will send the unit in for repairs. No refunds or exchanges are offered on demo units.
Products shipped in error
If you receive a product that is different to the one you ordered, you need to contact us within 24 hours of receiving it. We will make arrangements for the product to be returned to us and for the correct product to be delivered to you as quickly as possible. If the incorrect product is delivered to you, do not remove the product from its original packaging, open or use the product in any way. If the product is opened or use in any way and is not in mint condition, you may be liable for a 30% (of the original purchase price) handling fee.
Under no circumstances will Zion Digital (Pty) Ltd be held liable for any damage arising from any misuse or abuse of the goods, including any data loss whatsoever from storage media returned for exchange or repair.
5.7. Delivery of the Products
The anticipated time of delivery of any Products via the Website shall be indicated at the time that any order is accepted by us.
For all orders follow the below delivery estimates. Please note that these estimates are based on stock availability and are subject to the receipt of your payment in our bank account.
JHB Delivery Estimates: 2-5 working days

No deliveries will be made on public holidays and during weekends.
Our couriers can only ship to any physical address within South Africa but unfortunately we can’t ship to Postal boxes.
We hold stock of some items but other items we order from suppliers.
We will only start processing your order once we have received your payment in our account. Please note stock availability may fluctuate until then and on the odd occasion the supplier may run out of stock.
We will process your orders as quickly as possible. Orders placed on weekends or holidays are processed the following business day.

We can only ship your products once payment has been received into our bank account. Unfortunately providing us with a POP is not sufficient, as we often receive fraudulent POPs.
5.12. Late Delivery:
5.13. If a Product purchased from Zion Digital (Pty) Limited is not delivered within the agreed delivery period, or where no specific period was agreed, within 30 days after having purchased the Product, the ECT Act entitles you to cancel such sale on 7 (seven) days’ notice to Zion Digital (Pty) Limited by phoning 010 449 8947 . Should the Product purchased be unavailable, Zion Digital (Pty) Limited shall notify you and issue a full refund within 15 days after such notice.
5.14. Pricing, Online Content, Advertising and Printed Material
Whilst we make every possible effort to ensure that all Product information and pricing in any form of communication material is factually correct at the time of communicating it to the public, we cannot be held responsible if any factual errors occur beyond our control. Some descriptions or photographs may be of a generic nature and not specific to the particular product you wish to buy. However, should you be dissatisfied with the Product you receive for any reason, you are entitled to return the Product to Zion Digital (Pty) Limited in accordance with clause 5.6 above. All prices are inclusive of VAT unless otherwise stated. All prices include delivery costs. E&OE.
